Recognitions & Constitutional Validity

The National Council for Research in Education (NCRE) is a legally established autonomous body, registered under the Trust Act by the Government of National State and with the Planning Commission of India, which is governed by the Hon’ble Prime Minister of India.

NCRE operates in accordance with the National Education Policy 1986 and the Programme of Action 1992, both issued by the Government of India, and is committed to the development and democratization of education through Open and Distance Learning (ODL) systems.

As per the Human Rights Protection Act, 1993, autonomous educational bodies like NCRE are granted special protection and consideration (AIR 1993 SC 2178). Being an autonomous council, NCRE governs its educational programmes independently, in line with Articles 19(1)(g), 29, and 30 of the Constitution of India, which affirm the rights of citizens to pursue any profession and protect cultural and educational rights.

Each educational institution, university, or board in India is an autonomous entity and holds discretionary powers to accept or reject applications for admission or employment based on their own policies. NCRE’s educational programs fall under non-formal, autonomous education, and their legality, validity, and utility are upheld by Indian constitutional provisions.

According to the Ministry of Home Affairs, Government of India Notification No. 26/4/52 C.C. dated 20.09.1952, issued in consultation with the Union Public Service Commission (UPSC), degrees or diplomas awarded by Indian institutions established by an Act of Parliament or state legislature do not require separate recognition for employment purposes. Such qualifications are automatically recognized.

Additionally, NCRE is an ISO 9001:2008 certified institution, which ensures its services meet international standards of quality, reliability, and safety. This certification reflects NCRE’s commitment to minimizing waste, reducing errors, and improving overall institutional efficiency.

Autonomy and Acceptance

Educational boards and universities across India are autonomous bodies, and as such, the decision to admit students from another institution is at their discretion. NCRE students have successfully gained admission into various universities and secured employment in private sector organizations, a testament to the relevance and acceptance of NCRE programs.

NCRE is registered under the Societies Registration Act XXI of 1860, a legally recognized framework that validates its educational activities under Indian law. Since NCRE does not receive government or UGC grants, the UGC Act is not applicable.

NCRE functions in full alignment with constitutional Articles 14, 19(1), 21, 29, 30, 45, 46, 344, and 351. Its efforts to provide accessible, affordable, and quality education through distance and open learning are nationally appreciated.

The concept of Distance Education traces back to Berlin, Germany (1856), and gained international legitimacy in Russia and the UK with the establishment of the Open University by British Prime Minister Harold Wilson in 1969. In India, the New Education Policy of 1986 emphasized Open and Distance Learning (ODL), which NCRE has embraced wholeheartedly to serve underprivileged and non-traditional learners.
